Content on the Site, including articles, guides, downloadable templates, checklists, and tool results, is general information about cybersecurity and compliance. It is not legal advice, is not tailored to your organization, and does not create a consulting, advisory, or business associate relationship. That relationship begins only when both parties sign an engagement agreement.
SaberGuard assesses and advises. It does not warrant, certify, or guarantee compliance with HIPAA, 201 CMR 17.00, or any other law, and nothing on the Site should be read as a promise about the outcome of an audit, investigation, or insurance review.
No protected health information
You agree not to submit protected health information or other sensitive personal information through the Site, including in the contact form, the website security checker, or any email address published on the Site. See our Privacy Policy for what happens if you do.
Website security checker
The security checker retrieves publicly served HTTP response headers from the address you enter and grades them against common best practices. By using it you confirm that you own the website you submit or are authorized by its owner to assess it. You agree not to use the tool to scan sites you are not authorized to test, to overload it with automated requests, or to interfere with its operation.
Results are informational, reflect only the headers returned at the moment of the check, and are not a security assessment of the website or the organization behind it.
Downloadable resources
Templates, checklists, and guides offered on the Site are licensed to you for your organization's internal use. You may adapt them for that purpose. You may not resell them, offer them as your own product, or remove SaberGuard's attribution.
Intellectual property
The Site and its content, including text, design, graphics, logos, and the names SaberGuard and Ward Agent, are owned by SaberGuard, LLC or its licensors and protected by applicable law. Quotation with attribution for educational and journalistic use is welcome; other uses require written permission.
Acceptable use
- Do not attempt to gain unauthorized access to the Site, its hosting, or any system connected to it.
- Do not probe, scan, or test the Site's vulnerabilities except as permitted under our Trust Center's disclosure guidance.
- Do not use the Site to transmit malware, spam, or unlawful content.
- Do not misrepresent your identity or your authority to act for an organization.
Third-party services and links
The Site links to and may embed third-party services, including podcast platforms, GitHub, LinkedIn, our form processor, and our Trust Center. We do not control those services and are not responsible for their content, availability, or practices.
Disclaimer of warranties
The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on it is complete or current.
Limitation of liability
To the fullest extent permitted by law, SaberGuard, LLC and its principals will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from your use of or inability to use the Site or any content on it, even if advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed one hundred US dollars.
Indemnification
You agree to indemnify and hold harmless SaberGuard from claims, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these terms or your misuse of the Site, including unauthorized use of the website security checker.
Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Massachusetts, and you consent to their jurisdiction.
Changes
We may update these terms from time to time. Changes take effect when posted, and the date at the top of this page will change. Continued use of the Site after a change means you accept the updated terms.
